La réforme de la famille va-t-elle conforter la place des pères ?
Ségolène Royal : "Oui, au sens où il faut faire disparaître la notion de "résidence habituelle" de l'enfant qui dans les faits, privilégie le parent gardien au détriment de l'autre, considéré comme un parent de seconde zone. Elle crée une confusion avec l'autorité parentale ce qui entrave les droits du parent non gardien. C'est dommageable pour l'enfant, par exemple dans les relations avec l'école."

Ségolène Royal : "C'est effectivement nécessaire. Il faut que ce mode d'organisation soit explicitement reconnu et inscrit dans le droit. Après un certain délai, le jugement de divorce pourrait entériner la parité parentale, dès lors que les parents sont d'accord et que les enfants s'y retrouvent bien. Dans certains cas, la garde alternée se met en place avant le jugement de divorce, mais c'est la pratique de tel ou tel tribunal qui entérine ou pas cette organisation. C'est quand même dommage."
Donnez-vous raison aux associations de pères qui réclament de systématiser cette garde paritaire ?
Ségolène Royal : "Rien ne peut être systématique, c'est l'intérêt de l'enfant qui commande. Aux pères qui revendiquent un droit absolu, je rappelle que ce n'est pas l'enfant qui a demandé le divorce et que c'est sa sérénité à lui qui compte. La résidence alternée doit être traitée à égalité avec toutes les autres solutions. Ce n'est pas un modèle, mais c'est un mode d'organisation qu'il faut davantage encourager quand il permet de pacifier les divorces, d'empêcher les déménagements intempestifs, de répondre au droit de l'enfant de vivre sans conflit et de garder des liens avec ses deux parents."
